Terms of service

These terms are between you, the real estate agent or agency using Kerbready, and Kerbready, an Australian business. By signing up you agree to them.
1. What Kerbready is
Kerbready is a coordination and record keeping tool. It asks the trades you nominate for quotes, presents those quotes to your vendor, records what the vendor approves, books the work in your name and chases what is outstanding.
2. What Kerbready is not
- We are not a party to the work. The contract for any works is strictly between the vendor and the trade.
- We do not employ, engage, licence, insure, supervise or vouch for any trade.
- We are not a builder, a trade, a broker or a payment service.
- We give no warranty of any kind about the quality, timing, price, safety or legality of a trade's work.
3. Money
Kerbready never handles money for the work. Your vendor pays each trade directly on the trade's own invoice. We do not hold funds, split payments, take a commission, escrow anything or accept a referral fee from any trade. The only money that moves through us is the one off fee you pay us for a campaign.
4. Your responsibilities
- You have the vendor's authority to arrange quotes and pass them on, and the trade's consent to be contacted about work.
- The details you put in are accurate, including addresses, access notes and contact details.
- You check that a trade is licensed and insured where the law requires it. Kerbready records an expiry date you enter, it does not verify it.
- You comply with the Australian real estate laws that apply to you, including any state rules about arranging works on a vendor's behalf.
- You do not use Kerbready to send anything unsolicited, misleading or unlawful.
5. Approval records
When a vendor approves a quote we record the time, the quote, the approver and their IP address and browser. These records are provided as is, as a convenience. They are not legal advice, they are not a substitute for a signed authority where one is required, and we do not warrant that any record will be accepted as evidence in any proceeding.
6. Messages
Kerbready sends email and SMS in your name to the contacts you supply. You are responsible for having a reasonable basis to contact them under the Spam Act 2003 (Cth). Every email carries an unsubscribe link and every trade SMS carries a STOP instruction, and we honour both immediately across all channels for that address.
7. AI
Kerbready uses a language model to read replies and draft short messages. It can be wrong. Anything that materially changes a price, a date or a booking is either confirmed with the sender or raised for you to decide. You are responsible for what goes out in your name.
8. Fees, invoices and refunds
- Your first campaign is free. Every campaign after it is $99 AUD, once, paid through Stripe before the campaign starts.
- There is no subscription, nothing recurring and nothing to cancel. You pay only when you start a campaign.
- A campaign that has not been paid for sends nothing to anybody. Once it is paid, it is paid for up front and is never cut off part way.
- Every paid campaign gets a numbered tax invoice from us to your agency. Many agents pass that cost through to the vendor on the marketing schedule. That is between you, your agency and your vendor.
- Refunds are at our discretion, except where the Australian Consumer Law requires one.
- We may change the price on 30 days notice by email. The price you paid for a campaign never changes after you have paid it.
9. Your data
You own your campaign data. You can export it as a file at any time from settings. If you delete your agency, everything is hidden immediately and purged after 30 days. See the privacy notice for the detail.
10. Availability
We aim to keep Kerbready running but we do not promise it will be uninterrupted or error free. Scheduled maintenance and provider outages happen. Where an outage delays a message we will send it when service returns.
11. Liability
Nothing in these terms excludes any right you have under the Australian Consumer Law. Where the law allows us to limit liability, our total liability for any claim is capped at the fees you paid us in the twelve months before the claim. We are not liable for a trade's work, for a vendor's decision, for lost sale opportunities or for indirect loss.
12. Suspension
We may suspend or close an account that is used to send unlawful or unsolicited messages, that misrepresents who is sending them, or that puts our providers' accounts at risk. We will tell you why and give you your data.
13. Changes and law
We may update these terms and will tell you by email before a material change takes effect. These terms are governed by the laws of Victoria, Australia, and both of us submit to the courts of that place.
